These Early Access Program Terms ("Early Access Terms") apply to any beta, pilot, preview, early access, evaluation, trial, experimental, pre-release, or limited-release products, features, services, workflows, integrations, AI capabilities, dashboards, or functionality provided by Generex, Inc. ("Generex," "we," "our," or "us").
By accessing or using any Early Access feature or participating in any Early Access program, you agree to these Early Access Terms in addition to Generex's Terms of Service, Privacy Policy, Security documentation, and other applicable policies.
1. Purpose of Early Access
Generex may offer Early Access features to selected customers, partners, SMBs, VCCs, investors, advisors, or users to test, evaluate, improve, and validate emerging AI operational infrastructure.
Early Access features may include AI Growth Engine functionality, conversational AI systems, voice agents, Experience Window features, workflow automation, dashboard functionality, integrations, analytics, business outcome tracking, operational intelligence features, and other pre-release capabilities.
Participation in Early Access means you are helping shape an evolving AI business infrastructure platform.
2. Experimental Nature of Early Access Features
Early Access features are experimental, pre-release, and may be incomplete. They may contain bugs, produce errors, generate inaccurate outputs, operate inconsistently, change without notice, be temporarily unavailable, or be removed entirely.
Generex does not guarantee that any Early Access feature will become generally available, remain available, or operate in the same way in the future.
3. No Production-Critical Reliance
You should not rely on Early Access features for production-critical, safety-critical, legally sensitive, financially material, medical, compliance-dependent, or mission-critical operations unless Generex expressly agrees in writing.
You are responsible for maintaining appropriate backups, human oversight, alternative processes, and internal controls. Generex is not responsible for losses arising from reliance on Early Access features.
4. AI Outputs May Vary
Early Access AI features may generate outputs that are inaccurate, incomplete, inconsistent, delayed, unexpected, or unsuitable for your intended use. You are responsible for reviewing and validating all AI-generated outputs before relying on them.
Generex does not guarantee accuracy, reliability, revenue outcomes, customer conversion, operational performance, or business results from Early Access features.
5. Features, Roadmap & Availability May Change
Generex may modify, suspend, limit, replace, or discontinue any Early Access feature at any time. You acknowledge that product roadmaps may change, workflows may evolve, integrations may change, user interfaces may be redesigned, AI behavior may be adjusted, pricing may change, and feature availability is not guaranteed.
No statement about future functionality creates a binding obligation unless included in a signed written agreement by Generex.
6. Integrations May Evolve
Early Access integrations with CRMs, calendars, phone systems, messaging providers, dashboards, data sources, VCC systems, SMB systems, or third-party platforms may be incomplete, unstable, or subject to change. Third-party API changes, outages, permission changes, or service limitations may affect Early Access functionality.
Generex is not responsible for failures caused by third-party platforms or services outside its control.
7. Limited Support Obligations
Generex may provide support for Early Access features at its discretion. Support may be limited, informal, delayed, or unavailable depending on program stage, feature maturity, customer plan, engineering capacity, or operational priorities.
Generex does not guarantee specific support response times for Early Access features unless separately agreed in writing.
8. Feedback Rights
If you provide feedback, suggestions, ideas, requests, comments, bug reports, workflows, product recommendations, business process suggestions, or other input regarding Early Access features ("Feedback"), you grant Generex a perpetual, worldwide, royalty-free, irrevocable, transferable, sublicensable right to use, modify, incorporate, commercialize, and otherwise exploit such Feedback without restriction or compensation.
Generex may use Feedback to improve products, AI systems, workflows, dashboards, business models, operational frameworks, documentation, and commercial offerings.
9. Confidentiality
Early Access features may include non-public technology, strategy, workflows, designs, AI behavior, pricing, roadmap information, product concepts, or business plans. You agree not to disclose, copy, publish, share, benchmark, demonstrate, reverse engineer, or use Early Access information for competitive purposes without Generex's prior written consent.
This obligation survives termination of participation in Early Access.
10. Competitive Use Prohibited
You may not use Early Access features to build competing products, train competing AI systems, copy workflows, replicate Generex business logic, benchmark the Services for competitive purposes, reverse engineer platform architecture, extract prompts or system behavior, or develop derivative AI operational infrastructure.
Any competitive misuse may result in immediate termination and legal action.
11. Data Use During Early Access
Generex may collect and analyze usage, performance, interaction, workflow, and operational data from Early Access features to improve the platform. Such data may be used to identify bugs, improve AI behavior, evaluate workflow performance, improve reliability, test features, refine business outcome logic, and support platform development.
Generex's use of customer data remains subject to its Privacy Policy and applicable agreements.
12. Customer Responsibilities
You are responsible for configuring workflows appropriately, reviewing AI outputs, supervising automated actions, maintaining human oversight, complying with laws, obtaining required consents, protecting account credentials, and avoiding reliance on Early Access features for critical operations.
You are also responsible for ensuring that your employees, contractors, customers, users, and representatives comply with these Early Access Terms.
13. No Warranties
Early Access features are provided "as is," "as available," and "with all faults." Generex disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, non-infringement, and uninterrupted operation.
14. Limitation of Liability
To the maximum extent permitted by law, Generex will not be liable for any damages arising from or related to Early Access features, including lost revenue, lost profits, lost data, business interruption, customer loss, reputational harm, operational disruption, reliance damages, or consequential damages.
Your sole remedy for dissatisfaction with Early Access features is to stop using them.
15. Termination of Early Access
Generex may suspend or terminate your access to Early Access features at any time, with or without notice, for any reason, including security risk, product changes, misuse, competitive concerns, non-payment, violation of terms, or program completion.
Upon termination, you must stop using the Early Access features and any related confidential materials.
16. Relationship to Other Terms
These Early Access Terms supplement Generex's Terms of Service. If there is a conflict between these Early Access Terms and the Terms of Service regarding Early Access features, these Early Access Terms control for those features.
